Excerpt: As the hearing began, court heard in the agreed statement of facts that the Broncos’ bus was travelling between 96 kilometres-per-hour and 107 km/h at the point of impact, while the semi was travelling at between 86 km/h and 96 km/h. The bus driver took evasive action by applying a “hard brake” while Sidhu failed to recognize the hazard and took “minimal action” to avoid the collision, court heard.
According to the agreed statement of facts read in court, Sidhu was not distracted by a cell phone and did not have the sun in his eyes. Court also heard that trees along the southeast quadrant of the intersection would not have affected his visibility if he had stopped at the stop sign.
Court also heard that Sidhu missed at least four highway signs leading up to the oversized stop sign, and that his semi had completely entered the intersection when the Broncos bus struck the semi just ahead of the trailer’s wheels.
There was no way the bus driver could have avoided the collision, the Crown said.
